Damon Picotte, 39, of Macy, a member of the tribe, was sentenced up to 45 years in prison Dec. 14 for the 1999 death of a woman at her home. He pleaded no contest Oct. 4 in Thurston County District Court to the reduced charge of second-degree murder in the fatal shooting of Nancy Napolitano, 37. Thurston County received approval from the U.S. District Court to prosecute Picotte who was arrested by tribal police the night of the killing. County officials said Napolitano's Pender home was not on the Omaha Reservation. Tribal officials disputed that claim, but agreed with the decision to have Thurston County prosecute the case. Picotte was given credit for 497 days served and ordered to pay prosecution costs.
