Federal Court Ruling - LI Tribal Smoke Shops


Judge Carol Bagley Amon, a federal judge in Brooklyn, has ruled that businesses that sell cigarettes on Indian tribal lands are not exempt from federal, New York State or New York City tax laws. Judge Amon has issued a preliminary injunction to stop smoke shops on the Poospatuck reservation in Mastic from selling tax-free cigarettes to customers who are not members of the Unkechaug tribe, which controls the reservation. However, it is legal to sell untaxed cigarettes to tribal members for their own use.
